About these terms

These terms apply to your use of our websites and to every course you book with Kearns Environmental Health and Safety Limited, trading as Guardian Safety ("we", "us"), of Unit C1, Centrepoint Business Park, Oak Road, Dublin 12, Ireland. They cover:

  • food-safety.ie, food safety and HACCP training
  • manual-handling.ie, manual handling training
  • guardiansafetytraining.ie, our main training website
  • online.guardiansafetytraining.ie, our online academy, where online courses are bought and taken

By using the sites, booking a course or enrolling on the online academy you agree to these terms. If you are booking on behalf of a company or other organisation, you confirm that you have authority to accept them for it. Nothing in these terms affects the rights you have as a consumer under Irish and EU law.

Using our websites

The content on our websites is for general information about our courses and about food safety, manual handling and workplace health and safety in Ireland. We take care to keep it accurate and up to date, but it is not legal advice. Every business remains responsible for its own compliance with the law and with the guidance of the relevant authorities.

The text, images, course materials, videos, certificates and design on our sites belong to us or our licensors. You may read, print and share links to them for your own use. You may not copy, reproduce, sell or reuse any of it commercially without our written permission.

You must not do anything that could damage or interfere with the sites, try to access accounts or data that are not yours, or use the sites to send spam or unlawful material.

Online courses

Online courses are bought and taken on our online academy. Each purchase gives one named learner a personal licence to take one course. Licences may not be shared, and the assessment must be completed by the person whose name will appear on the certificate. Businesses buying for several staff receive one licence per learner.

  • Access. Your course is available as soon as payment is confirmed. How long you can access it is set out on that course's page in the academy at the time you buy, and differs from course to course. The access period stated on the course page forms part of these terms. Your certificate remains available to download from your account after the course access period ends, for as long as your account is open.
  • Assessment. You can attempt the end-of-course test as many times as you need to pass. Your certificate is issued the moment you pass and is available to download from your account.
  • Cancelling an online course. As a consumer you have 14 days from purchase to cancel and receive a full refund, unless you have started the course. When you start a course you agree that we begin providing the digital content straight away and that you lose the right to cancel once you have done so. Businesses buying online licences may cancel unused licences within 14 days for a full refund.
  • Technical requirements. You need an up-to-date web browser, an internet connection and audio. The courses work on phones, tablets and computers. If a technical problem on our side stops you completing a course we will fix it or refund you.
  • Changes. We update course content when regulations, guidance or best practice change. We may retire a course, in which case anyone enrolled will be moved to its replacement or refunded.

Trainer-led and group bookings

Trainer-led courses at our training centre in Dublin 12, at your premises, or as a live virtual classroom are booked by quotation.

  • Quotes. How long a quote is valid for is stated on the quote. A booking is confirmed when you accept the quote in writing or send a purchase order, and we confirm the date.
  • Group size. The maximum group size for each course is stated on the quote. Larger groups are split into more than one session so that everyone can be assessed properly.
  • At your premises you provide a suitable room with tables, chairs and a screen or blank wall for projection, and enough space for any practical work. We will tell you in advance what a particular course needs.
  • Attendance. You can substitute attendees up to the start of the course. Certificates are issued only to the people who attend the full course and complete its assessment.
  • Payment. Payment terms are stated on your quote and invoice. New customers may be asked to pay before the course. Late payments may be charged interest at the statutory rate.

Cancelling or moving a group booking

The notice required to cancel or move a booking, and any charges that apply, are set out in our cancellation and refund policy and on your booking confirmation. If we have to cancel a course, for example because a trainer is ill, we will offer you the earliest alternative date or a full refund. We are not liable for any other costs arising from a cancellation on either side.

Certificates

We issue a certificate to every learner who completes a course and passes its assessment. Certificates are issued in the learner's name as supplied to us, so please check spelling at the time of booking. A reissued certificate to correct a name is free within 30 days of the course, and we may charge a small fee after that.

A certificate records that the named person completed that course with us on that date. Whether a course meets a particular employer's, insurer's or inspector's requirement is a matter for them, and we describe on each course page the guidance the course is designed to follow. The refresher period for each course is shown on your certificate, and some employers or auditors may ask for training sooner if your duties change.

Employers, inspectors and other third parties can ask us to confirm that a certificate is genuine. We will confirm the learner's name, the course and the date, and nothing else.

Accreditation and how we describe our courses

Our courses are CPD accredited where the course page says so. Our food safety courses are designed to follow the Food Safety Authority of Ireland's guidance on food safety training, and our health and safety courses follow the relevant Irish legislation and Health and Safety Authority guidance. We are an independent training provider. We are not part of, and our courses are not endorsed or approved by, any government body or regulator unless a course page states a specific approval.

Prices and payment

Prices are shown in euro. Where VAT applies it is stated on the course page and on your invoice. We can change our prices at any time, but a price you have already paid or a quote you have accepted will not change. If a price on the site is obviously wrong we will contact you before taking payment.

Card payments are taken by our payment provider. We do not store your card details. Refunds are made to the card or account that paid.

Our liability

We will deliver our courses with reasonable skill and care. Our courses are training, not a guarantee that a business or a person will comply with the law, pass an inspection or avoid an accident, all of which depend on how the training is applied.

Nothing in these terms limits our liability for death or personal injury caused by our negligence, for fraud, or for anything else that cannot be limited by law. Subject to that, our total liability to a business customer for any booking is limited to the fees paid for that booking, and we are not liable for loss of profit, loss of business, or any indirect loss. Consumers keep all the rights they have under Irish and EU consumer law.

Your responsibilities

You agree to give us accurate booking and learner details, to make sure learners know the date, time and venue, and to behave reasonably towards our trainers and other learners. We can remove anyone who is disruptive or unsafe from a course without a refund. Course materials and sessions may not be recorded or shared without our permission.

Complaints

If something goes wrong, tell us. Email [email protected] or call 01 424 3013 and we will do our best to put it right quickly. If you are a consumer and we cannot resolve a dispute, you can use the EU online dispute resolution platform or contact the Competition and Consumer Protection Commission.

Privacy, changes and governing law

Our privacy policy explains how we use personal data and forms part of these terms. We may update these terms from time to time; the version on the site when you book is the one that applies to that booking. These terms are governed by the laws of Ireland and any dispute is subject to the jurisdiction of the Irish courts.
